History of Alaska Cannabis Legislation
1975: Alaska becomes the second state to decriminalize marijuana. Punishment became a fine rather than jail time.
1975: Ravin v. State affirms the 1975 decriminalization law. Alaska’s Supreme Court was the first and only state or federal court to announce a constitutional privacy right protecting any level of marijuana use and possession.
1982: Alaska’s legislature further expanded decriminalization. Possession of up to 4oz. within the home or 1oz. without was no longer a criminal offence.
1990: Alaska Measure 2 (1990), a ballot measure, passes and once again criminalizes marijuana possession with a punishment of 90 days in jail and/or a $1000 fine.
2003: Alaska’s Supreme Court struck down the part of Alaska Measure 2 (1990) criminalizing the possession of less than 4oz. of marijuana in Noy v. State.
2006: Marijuana is once again criminalized by Alaska’s legislature. This measure was pushed by former governor Frank Murkowski.
2014: Alaska Measure 2 passes on the ballot and legalizes marijuana statewide.
